A Fiji wedding contract is mostly a hotel contract with a ceremony attached, and the clauses that decide whether it goes well are the ones about numbers, weather, currency and cancellation. There are twenty worth reading properly and five worth negotiating. Everything else you can sign.
This is written for couples contracting directly with a Fijian resort or supplier from Australia, New Zealand or further afield. It is a checklist, not legal advice — see the note at the end.
What should you check before you read a single clause?
Three things that sit above the contract.
Who is the counterparty? The entity on the signature page may be a Fijian company, an offshore management company, or a booking agent. It determines who you chase if something fails and under whose law. Check the name on the contract matches the name on the invoice and the bank account you are asked to pay into.
What law governs it? Fiji, almost always. That is normal and not a reason to walk away, but it means a dispute is resolved in Fiji, at Fijian cost, in Fijian time. It is the strongest practical argument for insurance rather than litigation.
What is not in the document? Anything a coordinator promised in an email is not a term unless it is written in. Attach the email as an annexure or have it incorporated by reference. Enthusiastic coordinators change jobs.
The twenty clauses to read before you sign
| # | Clause | What to check |
|---|---|---|
| 1 | Parties and entity | Legal name matches invoice and bank details; a signing authority is named |
| 2 | Date, times and duration | Ceremony start, reception end, and whether the end time is a hard curfew |
| 3 | Ceremony location | Named specifically — "beach" is not a location; "Monkey Rock Beach" is |
| 4 | Guest minimum | The floor you pay for whether or not they come |
| 5 | Guest maximum | And what happens on the day if you exceed it |
| 6 | Per-head rate above the package | The exact figure, adult and child, and the age that defines a child |
| 7 | Final numbers deadline | Commonly 30 days out; after it, you pay for no-shows |
| 8 | Accommodation obligation | Nights bundled for the couple, and any requirement that guests stay on site |
| 9 | Deposit | Amount, due date, and whether any part is refundable |
| 10 | Payment schedule | Instalments, final balance date, and accepted methods |
| 11 | Card surcharge | Fiji has no cap; get the percentage in writing |
| 12 | Currency and FX | Which currency binds, and whether a quoted AUD/NZD figure is fixed or indicative |
| 13 | Taxes | Whether prices are inclusive, at what rate, and who wears a rate change |
| 14 | Wet-weather alternative | A named indoor or covered space, and who decides, and when |
| 15 | Cancellation by you | The sliding scale, by days out |
| 16 | Cancellation by them | What you get if the resort cancels — refund only, or relocation |
| 17 | Force majeure | Cyclone, epidemic, border closure; refund, credit, or nothing |
| 18 | Outside suppliers | Permitted or not, any fee, any accommodation obligation |
| 19 | Exclusivity | Whether another wedding can be held the same day, on the same beach |
| 20 | Marriage licence and paperwork | Who obtains it, whether the fee is included, and who runs to the registry |
Which five are worth actually negotiating?
Most of the twenty are standard and will not move. These five will, more often than couples expect.
1. The final numbers deadline. Thirty days is common. For a destination wedding where guests are booking international flights, you have better information at 21 days than at 30 — and the resort's food ordering usually does not require 30. Ask for 21, or for a small tolerance band either side of the confirmed number.
2. The tax change clause. Fiji's tax settings have moved twice in eighteen months: VAT dropped to 12.5 per cent on 1 August 2025, and a 5 per cent Tourism Services Tax commenced on 1 September 2026 for operators above FJ$2 million turnover. Fiji's Ministry of Finance has published that TST applies only to bookings made on or after 1 September 2026 — which means your booking date is a contractual fact worth recording in the document. If you contracted before that date, have the contract say so.
3. The wet-weather decision. The clause usually says the resort may relocate the ceremony. Ask for two things: the alternative space named, and a decision deadline — typically four hours before the ceremony — so you are not standing on a lawn at 16:00 arguing about cloud. The Remote Resort publishes that it can change the date with 24 hours' notice or set up on a covered deck; that is the standard to aim for.
4. Currency. If you are paying from Australia or New Zealand and the contract quotes AUD or NZD, ask whether that figure is fixed or indicative. InterContinental Fiji publishes AUD prices "based on the exchange rate with Fiji Dollar on 24 July 2025", which tells you exactly how indicative such figures are. Either fix the foreign-currency amount or accept that FJD is the price and budget the FX risk yourself.
5. The outside-supplier position. Very few Fiji resorts publish an external vendor fee, and most do not charge one — but almost all will require an island-based photographer or celebrant to be accommodated. Get the answer in writing before you contract with any supplier, not after.
What does a good cancellation clause look like?
Symmetrical, specific, and tied to days rather than "at the resort's discretion".
The things to look for, in order: a sliding scale by days out rather than a single cliff; credit rather than forfeiture for cancellations well ahead of the date; a named force majeure list that includes cyclone and government travel restriction, not a vague catch-all; and what happens if the resort cancels — a refund is the minimum, relocation or a contribution to rebooking is better.
Fiji sits in a cyclone belt with a season running roughly November to April. A contract that gives you nothing in a cyclone is not unusual, and it is the clearest signal that you need cover. Wedding insurance for a Fiji wedding sets out what is and is not insurable, and Cyclone season and your Fiji wedding has the honest risk picture.
The clauses nobody reads that cost real money
The reception curfew. Outrigger Fiji Beach Resort publishes that receptions must end at 10:00pm. That is a common Fijian condition and it shapes your whole run sheet. If you want a later finish, it is a negotiation to have before signing, not on the night.
The BYO position. Outrigger also publishes that BYO is strictly prohibited at private functions. VOMO Island Fiji publishes FJ$30 corkage per bottle instead. Those are opposite answers to the same question, and duty-free at Nadi is only a saving under the second one.
Blackout dates. InterContinental Fiji publishes specific windows in which weddings are simply not available, alongside a seasonal price step between its rate periods. If your date is near a boundary, check which side it falls.
The exclusivity question. Several resorts publish that they host only one wedding a day — Fiji Marriott Resort Momi Bay, InterContinental Fiji and The Remote Resort all say so. Others make no such commitment. If it matters to you, it belongs in the contract rather than in an assumption.
Before you sign: the four-email test
Send these four questions to the coordinator and keep the replies.
- Is there any fee, restriction or accommodation requirement for outside suppliers?
- What is the named wet-weather alternative, and by when is the call made?
- Is our quoted price inclusive of all current Fijian taxes, and what happens if a rate changes?
- Will any other wedding be held on the property on our date?
If all four come back clear and in writing, attach them to the contract. That single step resolves more Fiji wedding disputes than any clause you could draft.
This is a general checklist, not legal advice. Fiji wedding contracts are usually governed by Fijian law — take advice from a qualified Fijian legal practitioner on anything material, and confirm current tax treatment with the Fiji Revenue & Customs Service.
